BuySellClick respects intellectual property rights and expects all users to do the same. We respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).

1 Overview

BuySellClick is committed to respecting intellectual property rights. We have implemented procedures to receive and process notices of claimed infringement in accordance with the DMCA.

If you believe that your copyrighted work has been copied and is accessible on our platform in a way that constitutes copyright infringement, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information:

2 Filing a DMCA Notice

To file a valid DMCA takedown notice, you must provide the following information in writing:

Required Information

  1. Identification of the copyrighted work: Identify the copyrighted work that you claim has been infringed, or if multiple works are involved, a representative list.
  2. Identification of the infringing material: Identify the material that you claim is infringing and where it is located on our platform (provide specific URLs).
  3. Your contact information: Provide your name, address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
  6. Signature: A physical or electronic signature of the copyright owner or person authorized to act on their behalf.

Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages.

3 Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us containing the following:

Counter-Notice Requirements

  1. Identification: Identification of the material that was removed and its location before removal (specific URLs).
  2. Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  3. Contact information: Your name, address, telephone number, and email address.
  4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, for any judicial district, and that you will accept service of process from the person who filed the DMCA notice.
  5. Signature: Your physical or electronic signature.

What Happens Next

Upon receipt of a valid counter-notification:

  • We will forward the counter-notification to the complaining party
  • We will wait 10-14 business days
  • If the complaining party does not file a court action seeking a restraining order, we will restore the removed material

4 Repeat Infringers

BuySellClick has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers.

We may also, at our sole discretion, limit access to the platform or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Termination Policy

Users who receive multiple valid DMCA notices may have their accounts terminated permanently. Any funds remaining in their account will be handled according to our standard terms.

5 Policy Modifications

We reserve the right to modify this DMCA Policy at any time. Any changes will be effective immediately upon posting of the revised policy. Your continued use of the platform after any changes constitutes acceptance of the new policy.
